1. Agreement to Terms
By signing up for, accessing, or using DevHouse AI's services, you agree to be bound by these Terms of Service. If you don't agree to these terms, you may not use our services.
2. Description of Service
DevHouse AI provides:
- 24/7 call answering and response services
- Lead qualification and follow-up
- Appointment booking and scheduling
- Multi-channel communication management (phone, SMS, email, social)
- Daily summaries and reporting
We act as your authorized representative for handling inbound communications. You grant us permission to access your phone systems, calendars, and communication channels as necessary to perform these services.
3. Account Setup and Access
Your Responsibilities
- Provide accurate business information and call handling instructions
- Grant necessary access to phone systems, calendars, and communication tools
- Respond to our questions during the setup process in a timely manner
- Maintain working integrations and notify us of any changes
- Keep your account credentials secure
Our Responsibilities
- Configure your account according to your specifications
- Provide training materials and onboarding support
- Maintain the security and confidentiality of your data
- Provide regular reports on call volume and lead handling
4. Fees and Payment
Pricing
- Setup Fee: One-time fee of $2,000 (may be discounted during promotions)
- Monthly Service: Based on your selected tier (Starter $497, Growth $1,250, Scale $2,500)
- Overages: Additional charges may apply if you exceed your plan's call volume limits
Billing
- Monthly fees are billed in advance
- Payments are processed automatically via the payment method on file
- Setup fee is due before service begins
- Failed payments may result in service suspension after 7 days
- All fees are in USD and do not include applicable taxes
5. Service Level Commitments
We commit to:
- Answering calls within 60 seconds during active hours
- Responding to text/email inquiries within 2 hours during business hours, 8 hours after hours
- Providing daily summary reports
- Maintaining 99.5% uptime for our systems (excluding scheduled maintenance)
These commitments apply to our systems and processes. We are not responsible for failures caused by third-party services (phone carriers, your calendar system, etc.) or circumstances beyond our reasonable control.
6. Cancellation and Termination
By You
- You may cancel your service with 30 days written notice
- No refunds for partial months

By Us
We may terminate or suspend your account immediately if:
- You violate these Terms of Service
- You fail to pay amounts due after 14 days past due
- Your use of the service poses legal or security risks

7. Confidentiality

- Keep all business information confidential
- Not disclose customer information to third parties except as necessary to provide the service
- Use industry-standard security measures to protect your data
- Require our employees and contractors to sign confidentiality agreements
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not responsible for lost profits, lost revenue, or lost business opportunities
- We are not liable for issues caused by your failure to provide accurate information or maintain necessary integrations
We are not responsible for your business decisions or outcomes based on the information we provide. We answer calls and book appointments — business results depend on many factors beyond our control.
9. Indemnification
You agree to indemnify and hold harmless DevHouse AI and our employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the service in violation of these terms
- Your violation of any law or the rights of a third party
- Any content or information you provide to us
- Disputes between you and your customers
10. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
Dispute Process
- Informal Resolution: We encourage you to contact us first to try to resolve any dispute informally
- Mediation: If informal resolution fails, either party may request mediation
- Arbitration: If mediation fails, disputes will be resolved through binding arbitration in New York, NY
11. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or through your account. Your continued use of the service after changes constitutes acceptance of the updated Terms.
12. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and DevHouse AI regarding the service
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- Waiver: Our failure to enforce any right doesn't waive that right
- Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction
